DiKE Rechtliche Ausgestaltung des Genossenschaftswesens in Liechtenstein

The cooperative system in Liechtenstein is based on three different legal foundations: the law on individuals and companies, the law on citizen cooperatives, and the regulation on the European cooperative. This paper outlines their similarities and differences in their fundamental aspects. Starting from the historical foundations of the cooperative system in Liechtenstein—where 42.6% of the national territory is still owned by cooperatives today—the discussion extends to the recently emerged innovation cooperatives. From a Swiss perspective, the private law regulation of cooperatives in the law on individuals and companies is of particular interest. It is largely based on a preliminary draft by Eugen Huber for the Swiss Code of Obligations from 1919. The subsequent draft for regulation in the law on individuals and companies is published for the first time in this paper.
