The acquisition of an aircraft involves a large financial outlay. For this reason, aircraft and helicopters are usually financed by debt. In order to secure the creditor's capital risk associated with debt financing, the Cape Town Convention creates a uniform, international security interest in airframes, aircraft engines and helicopters. The registration of the international interest in an international register ensures its third-party validity. The international interest grants the creditor efficient liquidation measures upon the occurrence of the security event, and it governs the recognition and priority issues in the case of competing security interests within and outside of insolvency. The Cape Town Convention, consisting of the Convention on International Interests in Mobile Equipment and the Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Aircraft Equipment, was adopted by the International Institute for the Unification of Private Law (UNIDROIT) and the International Civil Aviation Organization (ICAO) in Cape Town on November 16, 2001. Since the Cape Town Convention entered into force on March 1, 2006, the number of member states has steadily increased. Since Switzerland is one of the signatory states, the question arises as to how the Cape Town Convention will be implemented in Switzerland in the event of a future ratification. This Lucerne dissertation examines the requirements that the implementation of the Cape Town Convention will impose on the Swiss legal system and how the Cape Town Convention will affect Swiss law. For this purpose, the conventional security interests in aircraft under Swiss law and the security interests of the Cape Town Convention are analyzed and compared.
