Product details
The bachelor's program is an introductory study that aims to familiarize students with the fundamental concepts of various areas of law. The exploration of the nuances of an increasingly extensive case law and literature must be reserved for in-depth study at the master's level. The personal law of the Swiss Civil Code regulates fundamental questions of private law, indeed of the entire legal system. To clarify the interconnections, natural and legal persons are presented in parallel in this script. The - particularly regarding legal persons and personality protection - (too) brief statutory provisions have inevitably led to an extensive 'compensating' case law (and almost limitless literature). Even a presentation that, like this script, focuses on the basics of this legal field cannot avoid references to the jurisprudence of the Federal Court; however, a discussion of the literature has been consciously omitted. The new edition takes into account the changes arising for personal law from the new Swiss Code of Civil Procedure and the significantly revised Civil Status Ordinance; both regulations came into effect on January 1, 2011. Furthermore, the terminological changes in personal law resulting from the new Adult Protection Law of December 19, 2008, have already been incorporated, even though this law will only come into effect on January 1, 2013.
