This work deals with qualified investors as well as Swiss and foreign collective investment schemes for qualified investors according to the Federal Act of June 23, 2006, on Collective Investment Schemes (Collective Investment Schemes Act, CISA). The primary aim is to outline and discuss the legal regulations and the practices of the Swiss supervisory authority in this increasingly significant area of the Swiss financial market. The focus is on examining the numerous indeterminate legal terms and provisions that require interpretation or specification, which arise from the framework nature of the legislation. Special attention is given to the legal changes resulting from the partial revision of the Collective Investment Schemes Act in 2012. The first part provides an overview of the origins and the constitutional and legislative foundations of collective investment legislation. The subsequent sections focus on qualified investors, Swiss collective investment schemes for qualified investors, and the legal consequences arising from the status of qualified investors or collective investment schemes for qualified investors, as well as the legal treatment of foreign collective investment schemes for qualified investors in Switzerland. An accompanying goal of this examination is to formulate statements regarding the framework structure of the Collective Investment Schemes Act as a meta-level of the present topic in a concluding reflection based on the insights gained.
