The question of the legality of mandatory vaccinations has been a prominent and controversial topic for years. In this work, the author demonstrates, based on practical research, the legal and labor law foundations for a state vaccination mandate or for a vaccination requirement imposed by employers in healthcare facilities and nursing homes. The work also comprehensively outlines the possible and lawful labor law sanctions in the event of a vaccine refusal, as well as the liability and criminal law consequences that both employees and employers may face in the event of an infection of a patient or resident. Sample formulations in the appendix are intended to assist healthcare providers in enforcing any vaccination requirements, minimizing liability risks, and protecting themselves from criminal consequences.
