This Bernese dissertation comprehensively presents all aspects of European passenger rights and provides courts, authorities, and practitioners with a foundation to inform themselves about passenger rights and assess claims from passengers. Following an introduction that relates passenger rights to the international and European foundations of air transport law, there is a section on the international private law aspects of the air transport contract and its contractual qualification. The focus of the work is on the detailed presentation of the circumstances that trigger benefits under the Passenger Rights Regulation: denied boarding, cancellation, and delay of flights. The possibilities for the operating airline to exculpate itself in cases of extraordinary circumstances are examined in particular detail, as well as the compatibility of the delay regulations of the Passenger Rights Regulation with those of the Montreal Convention. The work concludes with questions regarding the national enforcement body and the enforcement of claims under the Passenger Rights Regulation before Swiss civil courts.
