Persons who are of legal age and capable of judgement can generally act independently. Adult protection law comes into play when a person's independence is impaired as a result of a so-called debilitating condition (e.g. mental disability, mental disorder, dementia). Adult protection law is intended to have a remedial, compensatory or mitigating effect in order to safeguard the interests of the person concerned in the long term. To this end, it makes use of various instruments that either come into effect by law (e.g. the various representations pursuant to Art. 374 ff. of the Swiss Civil Code), are made by the person concerned themselves (advance care directive and living will) or are ordered by an authority in individual cases (various guardianships and involuntary placements).
The book offers a compact introduction to the subject matter of adult protection law (Art. 360-456 ZGB). It is aimed at law students as well as practitioners and other interested parties who are looking for an overview and a manageable approach to adult protection law.
