DiKE Dual-Use

The Federal Act on the Control of Goods for Civil and Military Use, as well as Special Military Goods, commonly referred to as the Goods Control Act, regulates not only the export of special military goods but also the export of goods that can be used for both civil and military purposes, known as dual-use goods. The Goods Control Act significantly impacts many areas of daily life. A large part of the Swiss industry is affected by the regulations of this law, as many of the capital goods it produces are accessible for dual use, meaning both civil and military applications. The qualification of whether a good is suitable for this dual use (dual-use) determines how and where it can be exported. This qualification is carried out with the help of goods lists. This monograph provides the necessary background knowledge regarding the export control of dual-use goods and explains the development, principles, and functioning of Annexes I and II of the Goods Control Ordinance, particularly the list of dual-use goods. The theoretical discussions are illustrated with numerous practical examples. A separate chapter addresses the tactical approach in cases of suspected violations of the Goods Control Act.
