Taking into account the revised Letter of Credit Guidelines (ERA 600) and recent case law, this book addresses the utilization of documentary letters of credit. It begins by answering fundamental questions regarding letters of credit, the legal framework, and the relationships between the parties involved. In particular, it discusses the risk-bearing associated with early payment of letters of credit with deferred payment. Following that, the requirements for document examination according to the principle of document strictness are explored. Cases are also presented where the bank has improperly accepted the documents and vice versa. Furthermore, the various reasons for preventing payment and their respective conditions are examined in depth. This includes the question of in which cases the bank may not honor the letter of credit, even though the documents are compliant. The author then develops a unique approach to preventing payment. Finally, the book discusses the procedural enforcement of payment prevention, particularly regarding precautionary measures under the new Code of Civil Procedure (ZPO).
