Product details

On January 1, 2011, the Swiss Code of Criminal Procedure came into force. This Bernese dissertation is the first work to comprehensively present appeals according to the new Code of Criminal Procedure. It draws on both the materials and the teachings and case law of analogous institutions at the cantonal and federal levels, which are reflected in a wealth of detailed and supplementary references. The work adopts a distinctly practice-oriented approach. In this sense, it aims not only to satisfy academic needs but also to serve courts, prosecuting authorities, and lawyers as a practical tool in their demanding work. Additionally, the book explores new territory through excursions, such as the previously neglected issue of reconsideration in decisions or orders with lasting effects. A detailed table of contents, an index, and numerous cross-references facilitate quick and easy access to the many discussions. Excerpt from the review of this book: "The work is able to answer a large part of the practical questions that arise in connection with appeals. This result is solely due to the fact that the author has thoroughly evaluated both the existing literature and case law on previous procedural laws as well as the materials and new commentaries on the Code of Criminal Procedure, anticipating new issues. The defined goal of 'serving courts, prosecuting authorities, and lawyers also as a practical tool in their demanding work' is easily achieved. 'The appeal according to the Swiss Code of Criminal Procedure' is able to dispel the concerns expressed by some practitioners that the introduction of the Code of Criminal Procedure would not be accompanied by a practically relevant enhancement of criminal procedure literature." (Stefan Heimgartner).
