Since the rejection of the EEA accession, Switzerland has been striving to prevent a legal isolationist course by adapting to EU law. However, despite a long tradition of rapprochement, significant questions remain largely unresolved: What level of harmonization does autonomous alignment require? Is autonomous alignment truly autonomous? What disadvantages does it have, and when does it fail to achieve its goals? Swiss collective investment law is considered one of the most prominent examples of European-determined financial market legal areas. This paper outlines the development of collective investment law in light of European influence and examines to what extent the different motives for EU rapprochement have been achieved. In addition to efforts to access the market, it specifically discusses whether and to what extent EU alignments lead to an increase in investor protection in this country.
