The tied assets according to insurance supervisory law are a special internal asset of the insurance company that must generally be established by any (direct) insurance company operating in Switzerland. These assets serve to cover the technical provisions listed on the liabilities side of the insurance company's balance sheet, which correspond to the existing and expected obligations of the insurance company arising from insurance contracts. These coverage values are intended to primarily enable the ordinary settlement of the insurance portfolio as a material guarantee of claims from insurance contracts, and if necessary, also independently of the economic fate of the insurance company. This St. Gallen dissertation examines the provisions that have now been standardized for life and non-life insurance with the entry into force of the completely revised insurance supervisory law on January 1, 2006, regarding the material guarantee of insured claims, and explains their legal effects in the ordinary course of business as well as in the insolvency of the insurance company.
