DiKE Besondere Betroffenheit als Element der Beschwerdebefugnis im Umweltrecht

In the current climate and biodiversity crisis, the existing regulation of the right to complain is reaching its limits. Especially when the consequences of environmental damage affect the entire population, defining the required "special" concern becomes difficult. Meret Rehmann explores the historical origins and societal functions of this requirement and opens up perspectives for alternative regulatory options. She also examines the provisions directed at the right to complain in the European Convention on Human Rights and the Aarhus Convention. As a result, the author presents approaches for reforming the right to complain in environmental law. In doing so, she also contributes to the further development of the dogmatics of administrative procedural law beyond environmental law.
