DiKE Abhandlungen zum Vermögensstrafrecht

The collected volume brings together 25 selected texts on property criminal law in the broadest sense from the years 1991 to 2017. Thematically, they range from legal theoretical considerations on property protection through criminal law to dogmatic fundamental and detailed questions regarding property, asset, and insolvency offenses, corruption, and breach of trust, as well as a systematic examination of the sanctions of European antitrust law. The individual essays are connected in two ways by a common objective. On one hand, they aim to incorporate the rules of the General Part into the design of the individual offenses. In this respect, the texts sometimes have an experimental character and deviate from the well-trodden paths of traditional interpretation and protective purpose provisions. On the other hand, the investigations are based on the endeavor to treat the offenses of property criminal law not as isolated cases but to integrate them into at least a rudimentary system. Such systematization aims to avoid evaluative contradictions wherever possible, not only within the individual offenses and offense groups but also in relation to civil law. A characteristic feature of this approach is the rejection of a factual perspective in favor of a consistently normative and civil law-accessory viewpoint.
