Should evidence that has been unlawfully obtained by law enforcement authorities be admissible in criminal proceedings? The Swiss legislator has introduced a regulation with Article 141 of the Criminal Procedure Code that addresses this issue. However, crucial delimitation and definition questions have been left to practice, which has so far failed to develop consistent solutions in this regard. This book presents various tools created by the author that provide remedies for this situation. In particular, a method for distinguishing between validity and procedural regulations has been developed. With this innovative approach, the work makes an important contribution to the dogmatics of criminal evidence law.
