Die Verselbständigung des Verwaltungsrechts gegenüber dem Privatrecht

Administrative law is today regarded as a distinct legal discipline in both German and Swiss law, as well as a subfield of public law. A look into legal history reveals that this has not always been the case, especially since administrative law was considered more civil law than public law for a long time. This work illustrates how administrative law and the science of administrative law could only establish themselves as an independent legal discipline through their separation from private law. Particular attention is paid to the historical development of central administrative law institutions within the tension between private and public law. In this respect, the work is also of interest for current questions regarding the distinction between public law and civil law.
