This work deals with a perennial topic of medical law - transplantation law. For decades, this has been the subject of intensive discussions and constitutional criticism. The latter concerns in particular the regulations that the Transplantation Act provides for post-mortem organ transplantation. For where capacities and resources are limited and supply and demand are diametrically opposed, an allocation decision must be made that usually means death for the patients not selected. Regulations on organ allocation that affect this highly sensitive and enormously fundamental rights-relevant area are thus particularly serious. Only after much hesitation did the legislature enact a law to regulate the transplantation system, delegating the decisive decision-making powers to various non-governmental institutions. The competence to issue guidelines in the field of transplantation that was thereby assigned to the German Medical Association is the focus of this paper and will be examined, among other things, using a concrete example of guidelines.

"The Guideline Activities of the German Medical Association in Transplantation Medicine. An Examination Using the Example of the Guideline on Liver Transplantation": The thesis deals with a perennial topic of medical law - transplantation law. The focus of the study is the guideline competence assigned to the German Medical Association (Bundesärztekammer) by the Transplantation Act (Transplantationsgesetz) in the area of post-mortem organ transplantation. A further focus is a detailed legal and constitutional assessment of the specific guidelines of the German Medical Association on liver transplantation.
