Die Praxis der Verständigung im Strafprozess

The so-called plea bargaining in criminal proceedings has been a highly controversial legal institution for a long time. In 2013, the Federal Constitutional Court certified the constitutionality of the relevant provisions in the Code of Criminal Procedure, but at the same time ordered the legislature to continually review the effectiveness of the protective mechanisms that serve to ensure compliance with the requirements of the Basic Law. This volume, presented by a research association of the universities of Düsseldorf, Frankfurt am Main and Tübingen, analyses how the applicable law is implemented in practice on the basis of an evaluation of case law and files of relevant proceedings as well as interviews with judicial actors.
