Die planungsrechtliche Baureife nach zürcherischem Recht

The planning law readiness for construction according to §§ 233-235 PBG is part of a wide range of instruments in spatial planning and construction law that exert negative effects to secure future plans. This prevents planning authorities from being confronted with completed facts by construction projects that contradict planning objectives, thereby impairing their decision-making freedom before or during the planning process. Despite a wealth of case law, this institution raises various questions that remain unresolved or insufficiently clarified to this day. The aim of this work is to address these gaps, especially considering the significant practical importance of planning law readiness for construction in light of the consistently high level of construction activity in the Canton of Zurich and the increasing frequency of legislative and planning revisions in spatial planning and construction law.
