Die neue EU-Marktüberwachungsverordnung

With the new Market Surveillance Regulation, European product safety law will undergo fundamental changes in 2021. It will come into effect on January 1 and July 16, 2021. In light of the increasing online trade and the ever more complex global supply chains, effective market surveillance and customs control will become central prerequisites for fair competition in the European internal market. However, the EU Market Surveillance Regulation is not only relevant for market surveillance authorities; it also introduces new tasks and obligations for various economic actors, some of whom – particularly fulfillment service providers – have not been explicitly covered by European product safety law until now. In this context, it specifically concerns new obligations for economic actors based in the EU regarding the EU declaration of conformity and technical documentation, the reporting of risky products, and the implementation of appropriate measures for market correction. Furthermore, the reform of the administrative information and communication systems is also practically important, as it aims to lead to a more effective design.
