Die Kritik des 184i StGB (Sexuelle Belstigung) und des 184j StGB (Straftaten aus Gruppen)

The criminal provisions on sexual harassment (§ 184i StGB) and group offenses (§ 184j StGB) are situated within a field of legal controversies and deserve thorough examination. While the regulation on sexual harassment is of central importance due to its relevance in everyday life and the protection against such behavior, § 184j StGB raises significant constitutional questions. In her work, the author illuminates the justification for these norms and addresses the legitimacy of the protected legal interest of sexual self-determination. Through an intensive analysis of the elements of the offense, the existing challenges and weaknesses are highlighted. Furthermore, the author engages with the expansion of the scope of protection to also include verbal and digital forms of sexual harassment. The investigation is rounded off by a comparative legal approach that culminates in a legislative proposal.
