While the German Insolvency Code primarily addresses procedural legal issues, the insolvency law section of the French Code de commerce contains highly relevant provisions that could be classified under corporate or general civil law in Germany. This systematic observation also applies to the highly debated legal issues of group insolvency, which have only been addressed by the German legislator in procedural terms. Alexander Arfert conducts a functional legal comparison of the substantive French group insolvency law with the applicable provisions of corporate, insolvency, labor, and civil law in Germany. He examines whether Germany has the right solutions to combat abuses and achieve the goal of sustainable restructuring in insolvency, and whether the French law offers transferable approaches.
