Pursuant to Art. 321a para. 4 CO, the employee is obliged to maintain confidentiality beyond the termination of the employment relationship insofar as this is required by the legitimate interests of the employer. In the context of the present work, this duty of confidentiality incumbent on the employee is examined in detail. The main focus is on the delimitation of the information to be kept secret according to Art. 321a para. 4 CO from the professional experience of the employee. In a further part, the criminal and competition law barriers to the exploitation of professional experience, in particular Art. 162 StGB and Art. 6 UWG, are dealt with. The book concludes with an extensive casuistry.
