The dissertation explores the role of the defense in the search for truth in criminal proceedings and the resulting legal dogmatic and policy implications. The consistent safeguarding of defense rights is an integral part of the search for truth in criminal proceedings, making the defense indispensable for the establishment of truth in this context. The author then contrasts this meticulously derived normative requirement with practice. He also thoroughly questions the previous arguments regarding numerous dogmatic individual issues as well as in legal policy debates, identifying misdevelopments in the current reality of criminal proceedings. As a result, this leads to a fundamental reassessment of the institution of defense and defense rights both de lege lata and de lege ferenda.
