The Amsterdam Treaty has given a strong impetus to the Europeanization of international civil procedure law. On this basis, the EU Regulation on the European Enforcement Order, which came into force on January 21, 2005, is also founded. At first glance, this regulation seems to facilitate cross-border transactions. However, upon closer examination, it also poses risks, primarily for the debtor. Court decisions also show that its application presents practical difficulties. The author dedicates her work to an in-depth analysis of the new regulation, examining it in all its facets before subjecting it to critical evaluation. She first presents the previously necessary enforcement declaration procedure under German law and the Brussels I Regulation (EuGVVO) to highlight the advantages and disadvantages of the new legal institution.
