Die Entsendung des Arbeitnehmers in die Schweiz und nach China

The deployment of employees far away from their place of origin is a phenomenon that can be increasingly observed, especially in the last decades, as a consequence of globalization and the internationalization tendencies of corporations. The focus of this study is on the posting of employees to Switzerland and China under the aspects of labor and immigration law as well as international private and civil procedure law. Various legal problems result from the posting, which are primarily due to the fact that at least two different legal systems are affected by cross-border employee activities. From a legal point of view, there are various possible arrangements in this context. The legal structure is of great relevance insofar as the various posting constellations can influence the applicable legal bases at the posting location.
