The deployment of employees far from their home location is a phenomenon that has become increasingly observable, particularly in recent decades, as a result of globalization and the internationalization trends of corporations. The focus of this study is on the posting of workers to Switzerland and China, considering aspects of labor and immigration law, as well as international private and civil procedural law. The posting gives rise to various legal issues, primarily due to the fact that cross-border employment activities involve at least two different legal systems. In this context, there are various legal structuring options. The legal framework is of great relevance, as the different posting scenarios can influence the applicable legal bases at the posting location.
