The study examines whether the current legal regulation is justified in allowing the spousal inheritance right to expire only upon final divorce. It does so in an interdisciplinary and comparative manner and also takes into account practical problems. In addition to critical reflections on the legitimation of (spousal) inheritance law, the overall context of inheritance and marriage law is taken into account, and contradictions in the current law are pointed out. This approach is supplemented by our own empirical study of some five hundred divorcees in three courts of first instance and by legal historical findings. The work demands that - as is already the case in property and alimony law - (spousal) inheritance law should be based on the factual reality of a marriage that is no longer intact and not only on the formal marriage bond.
