Die Beteiligung wirkungsbetroffener Dritter im Zivilprozess

The Swiss Civil Procedure Code explicitly provides for different institutions regarding the participation of third parties in proceedings. However, when a judgment directly affects the civil rights of third parties, these parties cannot always sufficiently ensure their right to be heard. This issue is comprehensively addressed in the present work using the example of the practically relevant corporate law challenge according to Art. 706 f. OR. The discussion is based on the latest literature as well as the most recent federal court rulings on the admissibility of ancillary intervention. Therefore, the work is aimed not only at legal scholars but also at practitioners in economic law. Author: Daniel Senn.
