Die Beachtung forumsfremder Eingriffsnormen bei vertraglichen Schuldverhältnissen nach europäischem

Intervention norms limit the principle of party autonomy that applies in international obligations. However, such norms are essential for a functioning economic order, as there must be limited corrective interventions by the state, such as in antitrust, competition, and consumer protection law, as well as in import and export restrictions. The Rome I Regulation, which has been in effect since December 17, 2009, also contains a provision on intervention law, which will be examined in this work for its suitability. The investigation will be conducted through a comparison with the provisions on intervention law enshrined in the Swiss Private International Law Act (IPRG). The focus of the discussion will be on the regulation regarding the consideration of foreign intervention norms in the Rome I Regulation and the Swiss IPRG.
