Product details

Construction insurance is part of the standard repertoire of insurances that a builder or contractor typically takes out when constructing a building today. The insured interests are broadly defined and regularly encompass economic disadvantages affecting various insured parties equally. This situation raises numerous questions both at the level of insurance law fundamentals and in practical terms, such as: "Whose interests are insured?", "How is the insurance benefit determined?" and "Against whom are recourse claims made?"

The present dissertation from Freiburg systematically presents construction insurance, starting from the insured interest, and addresses the raised questions as well as additional ones. The basis consists of the General Terms and Conditions currently used by larger insurance companies. The work outlines not only the objects, risks, and financial disadvantages covered by the insurance but also explains the mutual rights and obligations of the contracting parties and the insured. Finally, it comments on the much-discussed practice of advance payments by construction insurers.
