The challenges of digitalization are significant - at times they seem insurmountable. In ancient tragedy, a Deus ex machina often appears in hopeless situations, a deity descending via stage machinery to turn the situation around for the better. Similarly, in the debate on digitalization, technology or fundamental rights are sometimes invoked. On one hand, digital technology is believed to have the potential to solve societal problems and provide answers to the great questions of our time. On the other hand, the deity is seen in the fundamental rights that are presented as demands of digitalization. Constitutional law aims to regulate and shape the behavior and coexistence of people, setting goals for its future developments. The most important goals are the promises of free development, equal treatment, and democratic participation enshrined in fundamental rights. These must also be fulfilled under the conditions of digitalization.
