On January 1, 2012, the revision of the Real Estate Property and Land Register Law comes into force. At its heart are the paperless promissory note and the legal implementation of the transfer of ownership by way of security, which has been developed by practitioners and has now become standard practice. The book shown here presents these innovations in the sense of a guide for the practitioner. Numerous mortgage structures are presented, starting with the transfer by way of security of the registered and paper borrower's note through other forms of use to the pledging of a bearer bond with a mortgage bond. This is done in each case with appropriate references to the corresponding mortgage agreements as well as the legal basis statements for the land register, furthermore with explanations of the sometimes quite complex legal relationships between causal transaction, basic claim, basic lien claim and lien in rem. Graphical illustrations and synoptic comparisons support the reading. The book is aimed at all practitioners in the field of mortgage transactions, in particular credit institutions, notaries, land registry offices, lawyers and real estate trustees.
