Product details

The inheritance contract, as a bilateral legal transaction made in contemplation of death, represents an institution that has been subject to partly comparable, partly differing, and in some legal systems even impermissible regulations across the legal orders of individual European countries. On May 17th and 18th, 2018, a scientific symposium took place at the Faculty of Law at the University of Bern, during which the inheritance contract was examined from a historical and comparative legal perspective from the viewpoints of Germany, Austria, Italy, and Switzerland. Additionally, considerations regarding international private law and perspectives within the Anglo-Saxon legal sphere were discussed.

The present volume contains the written versions of the presentations delivered at the symposium in German or Italian. It also includes the discussions held in panel and plenary sessions. A synthesis concludes the work. The book provides an overview of the regulations and the current state of discussion in the various legal orders, addressing questions related to the institution of the inheritance contract and presenting possible solutions.
