Can the salaries of civil servants be reduced - the basic salary, the Christmas bonus, the allowances, the pension? A factual discussion about the question currently being actively debated in the media requires sufficient knowledge of the purpose of these rights and their constitutional foundations. This work provides information on this topic. It highlights the significance of the civil servant relationship as a loyalty relationship according to Article 33, Paragraph 5 of the Basic Law, as well as the resulting obligations to refrain from actions and to act. The obligations to refrain require the employer to avoid anything that could harm the civil servant. The established principles of professional civil service in Article 33, Paragraph 5 have only a clarifying significance. As an equivalent for their own services, the maintenance rights are also fully protected under the property guarantee of Article 14 of the Basic Law. Interventions in loyalty-protected rights are only permissible to avert an existential emergency.
