Datenlöschung einer Bank im Lichte der Datenschutzgesetzgebung Schweiz und EU

The ongoing digitalization is leading to constantly new possibilities for processing and storing large amounts of personal data. The increasing cases of data misuse are raising awareness about the desire to have control over one's own data, resulting in a growing urgency regarding data protection issues. An important aspect of data protection is the right to be forgotten, or - from the perspective of the data holder - the obligation to delete. This work addresses the question of the extent to which a deletion obligation exists for a bank according to the data protection laws of the EU and Switzerland. It examines the relevant legal foundations as well as the justifications for a bank's data retention and presents practical solutions for implementing the deletion obligation.
