Few legal institutions are feared by criminal law practitioners as much as asset forfeiture. It is generally regarded—as it has always been and still is—as too complex. The legislative goal of comprehensively seizing profits from crimes, because crimes should not be profitable, is thus undermined. The reform legislator of 2017 specifically aimed to eliminate the complexity of the legal provisions. If one searches for a reason why the confiscation of criminal proceeds is viewed unfavorably, one quickly finds it: the confiscation law is subject to numerous external influences. Above all, it is civil law and unjust enrichment principles that must be particularly considered in asset forfeiture law. This work aims to understand the confiscation of criminal proceeds consistently from a civil law and unjust enrichment perspective—especially taking into account national constitutional law and supranational regulations—in order to contribute to greater legal certainty in the reformed confiscation law.
