With the adoption of the Consumer Credit Directive 2008/48/EC, the European legislator has now also introduced a Europe-wide right of withdrawal in consumer credit law. The author examines the design of this right of withdrawal and compares it with the withdrawal provisions of the Distance Selling Directive for financial services, the Consumer Rights Directive, the Timeshare Directive, and the draft of a common reference framework. She investigates whether the right of withdrawal in the Consumer Credit Directive follows the consumer protection concept of the other European withdrawal rights and makes suggestions for further legal harmonization of the right of withdrawal, including consumer credit law.
