The work provides a comprehensive examination of the concept of sexual self-determination in criminal law. Taking into account the two key concepts of "autonomy" and "consent," the author defines the content and scope of the right to sexual self-determination and outlines the international legal requirements. Based on this normatively grounded principle of sexual self-determination, the norms of Swiss sexual criminal law are subjected to critical review. Through an extensive analysis, the author highlights inconsistencies and certain gaps in the existing sexual criminal law and subsequently formulates necessary proposals for amendments.
