Das Schiedsgutachten im schweizerischen Recht

In one form or another, expert opinions can be found in most legal systems. However, the reason for their binding nature is much more difficult to categorize than that of arbitration awards. Unlike arbitration awards, their binding nature cannot be clearly attributed—at least at first glance—to judicial authority, nor can it be distinctly assigned to party autonomy in legal design. Against this background, difficult questions arise regarding expert opinions, to which this dissertation provides answers.
