This dissertation primarily examines the material and procedural legal status of the injured party when they wish to take action against a solvent liability insurer due to a debtor who is unable to pay. For example, it highlights the newly introduced direct claim right resulting from the revision of the Insurance Contract Act, as well as the existing statutory lien of the injured party. The construction of a direct material or procedural legal relationship between the injured party and the liability insurer, using general legal institutes, is also the subject of investigation wherever a direct claim right does not exist.
