Crowdinvesting im Finanzmarktrecht

Crowdinvesting is discussed as a new type of financing method under Swiss law. Due to the recent financial and banking crisis, banks are granting loans and venture capital more restrictively. Crowdinvesting offers an alternative form of capital procurement, particularly for start-up companies. Thanks to crowdinvesting, young entrepreneurs can approach a large number of investors on the Internet and acquire capital. Numerous foreign legislators are convinced of the potential of crowdinvesting and are now discussing how to create a favorable legal framework. This Zurich dissertation first outlines the characteristics of crowdinvesting as well as regulatory approaches in selected European countries and the USA. Based on this, the current regulation under Swiss law is discussed, and approaches to the need for regulation under financial market law are developed.
