Compliance-Geschäftspartner-Due-Diligence unter dem UK Bribery Act

On July 1, 2011, the British Ministry of Justice surprised the world by enacting the UK Bribery Act, which is arguably the strictest anti-corruption law in the world and has the broadest scope of any anti-corruption legislation to date. For German companies, this means that as soon as they conduct business in the United Kingdom, they are subject to the stringent standards of the law. One of the key requirements of the UKBA is the implementation of appropriate preventive measures to prevent corruption within the company. These appropriate measures are further explained in the guidelines for the UKBA and include the demand for due diligence, meaning a thorough review of business partners from a compliance perspective. However, business partner due diligence has not yet become a standard practice or a fixed component of an adequate compliance management system in many German companies. For this reason, this book discusses the implications for German companies and the appropriate design of a compliance business partner due diligence.
