The commentary has set itself two goals: Firstly, it deliberately goes beyond the borders of Lower Saxony in its presentation of monument law and includes all other case law on monument law and the literature on German monument protection laws in addition to that of Lower Saxony. On the other hand, the title also offers a wide range of references from the literature and case law. With this approach, the commentary aims to facilitate the daily work of the many monument protection and local authorities dealing with monument law issues, but also to provide owners, lawyers and courts with quick access to the decisions. The new version takes into account the changes brought about by the Lower Saxony Building Code and the Lower Saxony Climate Act and updates and deepens the commentary on the use of renewable energies and property tax in particular. Andreas Kleine-Tebbe, retired presiding judge at the Administrative Court, and Christian Guntau, judge at the Administrative Court of Hanover, are jointly responsible for and comment on the regulations.
