Product details
The comprehensive commentary provides an in-depth, detailed, and practice-oriented analysis of the Federal Act on Debt Collection and Bankruptcy, the Federal Act on Debt Collection against Municipalities and other Corporations under Cantonal Public Law, as well as Articles 51-58 of the Federal Act on Mandatory Unemployment Insurance and Insolvency Compensation.
The new edition incorporates the extensive case law and literature that has emerged since 2010. Additionally, numerous legislative changes have been taken into account, particularly the revision of restructuring law, the new regulations on commercial representation, and the cancellation of unjustified debt collections. Further amendments to the Debt Collection and Bankruptcy Act (SchKG) have resulted from the revision of property law (registered mortgage), the Swiss Civil Code (adult protection), and the Code of Obligations (revision of limitation law; modernization of the commercial register), as well as from the Federal Act implementing the recommendations of the FATF (restriction on cash payments), the Federal Act on electronic signatures, and the Federal Act concerning the technology of distributed electronic registers (DLT proposal).
- The 3rd edition considers new practice-relevant case law and literature.
- Comprehensive, in-depth, and current commentary on the SchKG.
- The commentary provides practitioners, academics, and other interested parties access to the fundamentals and practice in the field of debt collection and bankruptcy law.
- The commentaries are clearly structured, and the text of the law is provided in all three official languages.
