Reform upon Reform
Since the landmark ruling of the Federal Constitutional Court in 2016, the Federal Criminal Police Act (BKAG) has been repeatedly reformed. The BKAG influences the design of state police laws and increasingly takes on the character of a "model police law."
The new Nomos Commentary on the BKAG offers, for the first time, a comprehensive, detailed, and critical analysis of the reformed norms. It decodes the complex new regulations regarding cooperation between the federal and state governments in criminal police matters, considers constitutional requirements, and outlines the EU legal framework for the provisions of the BKAG (GDPR, JI Directive).
The commentary enables a clear interpretation of responsibilities and powers in federal security law, particularly in the area of preventive counter-terrorism and prosecution by the BKA.
The editor, Prof. Dr. Tristan Barczak, LL.M., holds the Chair of Public Law, Security Law, and the Law of New Technologies at the University of Passau. In addition to constitutional and administrative law, his research focuses on security law, including police and regulatory law, assembly law, intelligence service law, as well as disaster and civil protection law.
Authors from legal science, administrative jurisdiction, and the authorities involved in the enforcement of the law, namely the Federal Criminal Police Office, the Federal Public Prosecutor General at the Federal Court of Justice, and the data protection officers of the federal and state governments, provide a balanced and practical representation.
