The offense with the highest penalty in Peru is the failure to pay child support. The aim was to assess the effectiveness of applying the principle of the child's best interests in cases of unpaid child support. In a population of 90 mothers, the sample was non-probabilistic, based on convenience, exploratory in nature, fundamental, and non-experimental in design. The technique used was a survey. The results showed that 20.00% believed that the procedure for the offense of failing to pay child support was inadequate, while 11.11% stated that the procedure was appropriate. Similarly, 18.89% felt that the application of the 'best interests of the child' was not taken into account, and 8.89% believed that its application was correct. In summary, the application of the principle of the child's best interests in cases of unpaid child support is inadequate.
