Besondere Verfahrensarten: Überlastung der Strafjustiz oder Ausdruck erhöhter Punitivit

The present study deals with the special types of proceedings in criminal procedural law, the penalty order proceedings and the summary proceedings. The criminal order procedure and the abbreviated procedure are analyzed in terms of their history of development and examined for their compatibility with the procedural maxims and the requirements of the ECHR. With a view to the increasing importance of these types of proceedings, the question of the background to this development is then examined. For this purpose, the thesis of the expansion of criminal law and its impact on criminal justice as well as the development of punitiveness are examined.
