Since the publication of Dr. Hermann Becker's commentary, 72 years have passed. During this time, the simple partnership has not only spread significantly in both economic and non-economic legal life, but its legal assessment has also changed. Hermann Becker already recognized that the simple partnership is not merely a contractual relationship, but a legal community. However, the understanding that the joint ownership relationship of the simple partnership grants external effects, allowing the partners to participate in legal transactions as a group of individuals and subjects of rights and obligations, has only developed more recently. Furthermore, the simple partnership now appears in even more diverse forms and variations—such as a silent partnership or as a co-ownership relationship. The new Bernese commentary on the simple partnership, which in this first volume addresses Articles 530-544 of the Swiss Code of Obligations, explores the doctrinal questions. It assists practitioners in dealing with the challenges that arise from the diverse application of this legal form in everyday legal practice.
