The new commentary on the law of contracts for work (Art. 363-379 OR) will be published in four parts. The present first volume covers Art. 363-366 OR. These four provisions vary in significance. The most important is Art. 366 OR, particularly in a theoretical and dogmatic context. This provision is therefore at the center of the commentary, alongside Art. 363 OR ("By the contract for work, the contractor commits to producing a work and the client to providing compensation."). Where Swiss doctrine and case law lack relevant answers, comparative legal references are made. The theoretical presentation is repeatedly supplemented with practical examples, especially in the commentary on Art. 366 OR, which raises particularly complex issues.
