The work examines a practically relevant problem area of inheritance law: the interpretation of testamentary dispositions and their relationship to the law of error. With constant reference to important principles, the entire spectrum of general will interpretation is illuminated, from literal interpretation to the observance of external circumstances, favor testamenti and benigna interpretatio to the theory of suggestion and the significance of formal requirements. If circumstances exist which the testator did not consider when drawing up his decree, the hypothetical interpretation of how the testator would have tested if he had considered these circumstances is investigated. In the area of the right of error, also explained in detail, the author deals with Univ.-Ass. Thomas Aigner, among other things, described various types of error, the important question of the materiality of the error, and the errors resulting from the knowledge gained.
